By using SiamTranship.com and submitting a booking, you agree to these Terms & Conditions in full. If you do not agree, do not use this service.
These Terms apply to all users of SiamTranship.com, including USA buyers and Thai sellers who interact with our platform and service.
Service Description
Siam Tranship provides transhipping and coordination services for live freshwater ornamental fish shipped from Thailand to the United States of America. Our service includes:
- Coordinating shipment logistics between Thai sellers and USA buyers
- Managing scheduled shipment dates and cut-off dates
- Collecting and processing transhipping fees
- Arranging air cargo from Thailand to USA
- Coordinating USA delivery or airport pickup
Buyer Obligations
As a USA buyer using Siam Tranship, you agree to:
- Provide accurate and complete personal information in the booking form
- Provide a correct and deliverable USA address
- Be available to receive the shipment at the scheduled delivery time
- Complete payment of the transhipping fee before the cut-off date
- Ensure compliance with applicable US federal, state, and local laws regarding the import and possession of the purchased species
- Review and accept our Shipping Policy, DOA Policy, and Refund Policy before submitting a booking
- Not misrepresent fish species, quantity, or other information in the booking form
Seller Obligations
Thai sellers who participate in Siam Tranship shipments agree to:
- Only sell fish that are in healthy condition suitable for air transport
- Pack fish according to safe air transport standards (oxygen, appropriate water ratio, secure bags)
- Deliver fish to the agreed consolidation point by the cut-off date
- Provide accurate information about fish species, counts, and sizes
- Not make promises to buyers that conflict with Siam Tranship's policies
Payment Terms
Transhipping fees are due at the time of booking confirmation. Bookings are not confirmed until payment is received. Siam Tranship uses secure third-party payment processors. Payment is collected in USD.
The transhipping fee does not include the cost of fish, which is paid separately to the Thai seller. Fish purchase transactions are entirely separate from Siam Tranship's services.
Prices and fees are subject to change. The price shown at time of booking is the price charged.
Limitation of Liability
To the maximum extent permitted by applicable law, Siam Tranship's liability is limited to the transhipping fee paid by the buyer for the specific booking in question.
Siam Tranship is not liable for:
- Fish quality, health conditions, or seller representations made outside our service
- Fish deaths resulting from seller packing failures, pre-existing health conditions, or buyer handling errors
- Losses caused by delays due to airline, customs, weather, or carrier disruptions
- Losses resulting from incorrect addresses, missed deliveries, or late pickups by the buyer
- Import restrictions, confiscation, or legal issues related to species legality in the buyer's jurisdiction
- Indirect, consequential, incidental, or punitive damages of any kind
Third-Party Services
Siam Tranship works with third-party logistics providers, airlines, customs brokers, and payment processors. We are not responsible for the actions or failures of these third parties beyond what is described in our Shipping Policy.
Thai sellers are independent third parties. Siam Tranship does not control their actions and is not responsible for their fulfillment, quality, or conduct.
Force Majeure
Siam Tranship shall not be held liable for failure or delay in performing its obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemic, government action, airline strikes, customs disruptions, or war.
Dispute Resolution
In the event of a dispute, we ask that you first contact us directly through our Contact page to attempt an informal resolution. We commit to responding within 3 business days.
If an informal resolution cannot be reached, disputes shall be governed by applicable law. Siam Tranship operates under Thai law for operations originating in Thailand, and applicable US federal and state law for services delivered in the USA.
Modifications to Terms
Siam Tranship reserves the right to modify these Terms & Conditions at any time. Updated terms will be posted on this page with the updated date. Continued use of the service after changes are posted constitutes acceptance of the revised terms.
